These Terms of Service ("Terms") govern your use of the website at moldtestingcalifornia.com and the mold testing and inspection services provided by Mold Testing California ("we", "us", "our"). By using our website or engaging our services, you agree to these Terms.
Services Provided
We provide professional mold testing and mold inspection services in Los Angeles and Ventura Counties, California. Our services include:
- On-site mold inspection using calibrated moisture meters, thermal imaging, and trained inspection personnel.
- Collection of air samples, surface samples, or other appropriate samples following industry-standard methodology.
- Submission of samples to AIHA-accredited laboratories for analysis.
- Delivery of written reports including laboratory findings and plain-English interpretation.
- Post-remediation verification testing when requested.
We do not perform mold remediation, water damage restoration, plumbing repair, construction, or any other services beyond independent mold testing and inspection. When findings indicate that remediation is warranted, we can refer you to independent remediation contractors; we do not take referral fees and remain unaffiliated with remediation providers.
Scope and Limitations
Our services are professional opinions based on industry-standard methodology, laboratory analysis, and reasonable inspection of accessible areas. We do not:
- Guarantee that all mold or moisture conditions in a property will be detected. Hidden conditions in inaccessible areas may not be discoverable.
- Provide medical advice or diagnose health conditions. Our reports characterize environmental conditions only.
- Provide legal advice. Our reports may be used in legal proceedings, but legal counsel should be consulted for any legal questions.
- Provide engineering, structural, or construction assessments outside the scope of mold-related moisture investigation.
- Guarantee specific outcomes from any remediation work performed by third parties based on our findings.
Service Agreements and Payment
Each engagement is governed by a service agreement that specifies the scope of work, pricing, and deliverables. Pricing is provided in writing before work begins, and payment terms are stated in the service agreement. We do not perform work without a written agreement.
Payment is due upon delivery of the written report unless otherwise specified. Late payment may incur reasonable collection costs.
Property Access and Cooperation
Our services require physical access to the property being inspected. The customer is responsible for arranging access, including any necessary permissions from co-owners, HOAs, or tenants. We are not responsible for delays or additional costs resulting from access issues.
Report Use and Confidentiality
Written reports are provided to the customer who engaged our services. The customer may share the report at their discretion (for example, with insurance adjusters, real estate parties, attorneys, or remediation contractors). We treat customer information confidentially as described in our Privacy Policy, except as required by valid legal process.
Reports may be used as evidence in California disclosure obligations, insurance claims, habitability disputes, and legal proceedings. We provide reports in formats suitable for these uses.
Disclaimers
Our services are provided on a professional best-effort basis. We make no warranties beyond those expressly stated in your service agreement. To the maximum extent permitted by California law, our total liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim.
We are not responsible for:
- Conditions that developed or changed after our inspection.
- Hidden conditions in inaccessible areas that were not reasonably discoverable.
- Actions taken by remediation contractors or other parties based on our findings.
- Decisions made by insurance companies, courts, or other parties relying on our reports.
